1.1. Active Stirling Ltd is a registered charitable trust (SC037632) for sport, physical activity and wellbeing and a sole member of Stirling Council.

1.2. These terms and conditions cancel and replace any previous versions.

1.3. By making a booking in our facilities, you agree to be bound by these terms and conditions. (Please print or save these terms for future use as we will not keep a file copy specifically for the transaction with you). If you do not wish to be bound by these terms, you should not book our facilities or programmes.

2.1. Pay as You Go

Pay-As-You-Go bookings are for individuals who do not have an active membership/Block Booking and will pay for each individual activity that they book

2.2. Member booking

Member Bookings are where individuals that have an active membership subscription can book activities as part of that membership and as such do not incur a further charge.

2.3. Block Booking

Block Bookings are for individuals/clubs/teams who wish to reserve facilities overseen by Active Stirling on average once a week. Bookings with less frequency than this will be considered and the final decision will reside with the Bookings Team.

2.4. Commercial bookings can be classed as requests received from an organisation or company to book facility space which offers a service or product that can be bought by or is intended to be bought by the general public.

3.1. All bookings must be paid for in advance.

3.2. Repeated failure to pay for facilities in advance or at all will result in all future bookings being cancelled until payment is received. If no payment is received, unpaid debt will be sent to the Sheriff office.

4.1. Block Bookings are not granted on a first come first served basis. Each application is evaluated against our Sports Usage Policy. As a result, all bookings are reviewed on an annual basis. The Usage Policy can be requested by e-mailing the Bookings Team on bookings@activestirling.org.uk. During the present time we are also required to align requests with the Active Stirling reinstatement route map as well as relevant Government and Governing Body guidance.

5.1. No refund will be issued if you cannot attend your booking or if you fail to arrive on time for your booking.

5.2. In the unfortunate event that Active Stirling must cancel an activity, a credit shall be issued to each user who made a pay-as-you-go booking for that activity. The credit may take up to 48 hours to apply to each account.

5.3. For Block Bookings, a minimum of 48 hours’ notice must be given in writing. This notice period is only applicable to an individual date. Any cancellation or amendment request that impacts consecutive weeks will be considered a breach of these terms and as an abuse of the block booking system and will not be processed. A credit will be given for all block bookings cancelled within their appropriate time scales. It is the responsibility of the booking applicant to ensure that each week’s activity is paid for irrespective of use or not, unless they have cancelled in accordance with the above notice periods.

5.4. For Block Bookings, any amendment to reduce the booking or change the date will be treated in line with the cancellation policy above.

5.5. Termination of block booking – any booking applicant wishing to cancel their entire block booking or amend a full block, i.e. the same session every week, must request this in writing. A minimum of 28 days’ notice must be given. The booking applicant may not attempt to cancel or amend the bookings that fall within the 28 day period.

5.6. All outstanding fees must be paid up to date before the termination request will be accepted. Unpaid debt will be sent to the Sheriff office.

5.7. Repeated failure to pay or appear for the booking will result in termination of all future bookings. Active Stirling reserves the right to cancel any bookings of customers whom they deem are continually abusing the booking system.

5.8. Refunds will only be given in exceptional circumstances and if the required notice period has been given. Requests must be made in writing to the Bookings Team at bookings@activestirling.org.uk.

6.1. Active Stirling will not be held liable for accident to person(s) or loss of property by any person or organisation while on the premises or in the grounds, unless as a direct result of our negligence or our failure to take reasonable care.

6.2. All clubs/companies using these facilities must have Public Liability Insurance cover and by signing the Booking Form you are confirming you have this in place. The booking applicant must send a copy of this document as requested by Active Stirling. Failure to do so may result in cancellation of your booking. Spot checks will be carried out at random throughout the year.

6.3. All clubs will also be held liable for any loss or damage of equipment and facilities used.

7.1. Active Stirling adheres to the Standards for Child Wellbeing and Protection in Sport:


Any organisation booking Active Stirling’s facilities should also adhere to these Standards.

“I can confirm that our organisation meets the Standards for Child Wellbeing and Protection in Sport and meets the Minimum Operating Requirements for each Standard.”

By signing the booking form you are confirming the above statement.

7.2. In addition to this coaches and volunteers are required to have a qualification appropriate to the level they coach.

7.3. If you require further assistance regarding Standard for Child Wellbeing and Protection in Sport please contact your Community Activation or Sport Development Officer.

7.4. Active Stirling reserves the right to carry out spot checks of any individual or organisation to ensure they have the appropriate processes in place.

8.1. Each individual will be responsible for their behaviour whilst using any Active Stirling service. In particular, users must adhere to all social distancing and safety measures in place throughout The PEAK. Any failure to comply may result in their being asked to leave and a refund will not be issued.

8.2. It is the responsibility of the bookee to notify Active Stirling in writing of any changes to their name, address, contact number, e-mail and job/club role.

8.3. The club/individual making the booking will be responsible for the behaviour of their group and any damage caused by group members. For the benefit of all our customers we would ask that you do not smoke, drink alcohol, use illegal substances, or use abusive language whilst at the facility. Active Stirling reserves the right to cancel any bookings if behaviour of participants is unacceptable – no refund will be issued.

8.4. The lead booker for each booking is solely responsible for recording the details of the other participants for COVID-19 contact tracing purposes in line with data protection regulations.

8.5. All Players should wear appropriate footwear:

(i) Pitch Users (3G synthetic, 5-a-side pitches & hockey pitch) must wear trainers or moulded rubber studs. Under no circumstances should blades, metal studs or Hybrid boots be worn as they will damage the pitch surfaces

• The costs of rectifying avoidable damage may be re-charged to the bookee responsible for such (spot checks will take place and you could be at risk of losing your booking if incorrect footwear is being worn).

• If you are responsible for a youth group (Under 16s) please ensure all members are adequately supervised at all times whilst on the premises.

8.6. You should not visit The PEAK if you have any symptoms related to and/or have been knowingly exposed to COVID-19.

8.7. You should follow Scottish Government advice on wearing a face covering.

8.8. You must keep at least 2 metres between yourself and other persons while using Active Stirling services.

8.9. You must disinfect all equipment after use in the gym and should not enter closed off areas. You must keep your hands washed/sanitised while at The PEAK.

9.1. Bookings finish one minute before the hour or half hour, for example 5.00pm to 5.59pm to ensure there is a smooth and quick turnaround for participants. Players must strictly adhere to their booking times and vacate the pitch in a timely manner.

9.2. Please note spot checks will be made to ensure facilities are being used by the intended booker, at the requested time and that the facility has been paid for.

10.1. Discounts must be applied for at the time of the booking request and are granted at Active Stirling’s discretion.

10.2. Clubs affiliated to Clubsport Stirling will receive the appropriate discount in line with their affiliation status. Discounts are applied at Active Stirling’s discretion.

11.1. Commercial bookings are liable to pay an additional 15% surcharge for all facility bookings made with Active Stirling.

11.2. Facility hire charges will be reviewed on an annual basis. Charges include access to changing facilities, use of floodlights and VAT where applicable.

ALL IN members were notified on 19 April 2021 that memberships would be automatically unfrozen from 1 June.

Swim, gym, fitness, skate, climb and play included within the ALL IN membership are subject to availability and change.

Some of the activities may not be available at times due to programming, facility maintenance or other external factors such as Scottish Government Guidelines, adverse weather and may include temporary closures of some or all elements of The PEAK as a facility. Refunds will not be granted for limited or reduced amount of activities available as part of this membership.

ALLIN Communities

Amending a membership
Adding/removing members must be put in writing by e-mail to membershipsales@activestirling.org.uk. Amendments are subject to one full calendar months’ notice.

To cancel your membership, please e-mail membershipsales@activestirling.org.uk. All cancellations require one full calendar months’ notice. If a Direct Debit has been cancelled without notification, this will be deemed as being in breach of the terms and conditions and an admin fee will apply.

Cash memberships
Cash memberships are available at an additional cost to our advertised membership prices. Contact us at membershipsales@activestirling.org.uk for prices.

Concessions are available so check with us at membershipsales@activestirling.org.uk. Proof is required every 6 months with the exception of over 60’s. Failure to provide proof will mean price charged will automatically change to the normal adult rate.

All data collected is in accordance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR) 2016 and is used by Active Stirling in accordance with our privacy policy. It is the member’s responsibility to ensure the data we hold for them is up to date and accurate.

Direct Debit
All Direct Debits are a legally binding contract between Active Stirling and the Direct Debit payer and represent a commitment to pay all monthly membership fees due on the 1st day of the calendar month. If a Direct Debit payment has defaulted, memberships will be cancelled with immediate effect and an administration fee will apply. Members will not be permitted to re-join any membership scheme until all due amounts are paid in full.

All correspondence regarding the Direct Debit will be sent to the Direct Debit holder.

Direct Debit Guarantee
Please pay ‘Active Stirling’ direct debits from the account detailed on my DD instruction. Subject to the safeguards assured by the Direct Debit Guarantee. I understand this instruction may remain with Active Stirling and if so, details will be passed electronically to my bank/building society.

Facility Usage
A health commitment statement must be accepted by all members before taking a membership. Any changes in health must be reported to the facility immediately.

Fitness classes
Fitness classes can be booked up to 7 days in advance, subject to availability. Please provide 24 hours notice if you are unable to attend a pre booked fitness class. Failure to attend pre booked classes may result in online booking privileges being withdrawn. Fitness classes can be booked and cancelled online or via The PEAK app which is available on the App Store or Google Play.

Freezing membership
The minimum period for freezing a membership is 1 calendar month and the maximum is 4 calendar months.

Freezing a membership is subject to one calendar month’s notice. Longer dates may be considered and put in writing to membershipsales@activestirling.org.uk

Once the Health Commitment Statement is signed you can start using our gyms. Inductions are available for programmes and advice which are included in your membership.

Gym users aged 12–15
Gym users aged 12–15 must be accompanied by an adult at all times out with the published junior membership times.

Gym users turning 16 years will automatically change from junior to single adult membership when the child reaches the age of 16 unless the account holder notifies us by e-mailing us at membershipsales@activestirling.org.uk

Key fobs
Key fobs will be issued to all members and a photograph for internal use only will be taken on your first visit. Any lost or stolen fobs must be reported immediately. A charge of £1 will apply for a replacement fob. Key Fobs are not transferrable between members or with any customer. Contactless wristbands are available for an extra charge.

Members Under 16 years
If a member is under the age of 16, the membership application must be completed by a Parent/Guardian.

Membership fees
Our membership fees and prices are reviewed annually and will be implemented from the 1st October each year. The customer will be given one calendar month’s notice of any proposed increase and will have the right to terminate their agreement using the standard cancellation procedure. Failure to cancel will imply acceptance of the changes and/or increase.

Members who pay an annual or short-term membership require renewing such membership on or before the expiry of the current membership to continue to receive member benefits. Such renewal shall be at the rates applicable at the date of renewal.

Active Stirling reserve the right to run membership promotions and special offers throughout the year, which may offer memberships at a different price from that advertised.

Membership Refunds
You have the right to cancel your membership within the first 7 days of commencement. If you do cancel within this initial 7-day period, any membership payments incurred by you during that time will be refunded. Pre-paid memberships are non-refundable unless a letter from a GP on medical grounds is provided. If all facilities are unavailable due to unplanned closures for a period of 48 hours or more then refunds will be given covering the full duration of the closure. Prepaid memberships will be extended for the period of closure.

Refunds will not be granted for limited or reduced amount of activities available as part of this membership.

Membership Use
Memberships are for use by the named members only and not for sharing with others. Any abuse of membership privileges can result in automatic cancellation with no refunds provided.

Terms and conditions
Active Stirling reserves the right to review their terms and conditions from time to time. Members on the Direct Debit scheme will be given a minimum of 14 day’s notice of any proposed changes.

Active Stirling reserves the right to refuse any application for membership and do not need to give reason(s) for refusal.
